Rental Terms
All vehicle rentals come with a comprehensive Rental Agreement that you will receive at the time of booking confirmation or vehicle pickup. This agreement outlines the specific terms, conditions, insurance information, applicable charges, and your obligations during the rental period. In case of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement will prevail.
Eligibility Criteria
Vehicle Rental Requirements
- To hire a vehicle from Ely Car Hire, you must be at least 21 years old, although age restrictions may vary depending on the vehicle type. Drivers under 25 may incur additional charges. A valid driving licence suitable for the vehicle category is required, along with proof of identity and current address. Payment information and a security deposit must also be provided, along with any other criteria outlined in the Rental Agreement.
Booking and Payment Process
- Reservations can be made via our website, over the phone, or at our Dartford office. A deposit may be needed to confirm your booking. The total payment, along with a security deposit, is usually required upon collecting the vehicle. All prices are listed in British Pounds (£) and include VAT where applicable. We accept major credit and debit cards through secure payment methods.
Vehicle Pickup and Drop-off
- At the time of vehicle collection, it is your responsibility to conduct a thorough inspection and report any pre-existing damage without delay. A vehicle condition report will be completed and signed by both parties. The vehicle should be returned in the same condition as when it was collected, taking into account standard wear and tear. Any new damage will be evaluated, and charges may apply accordingly. Please return the vehicle with the same fuel level as it was provided; refueling fees will apply if it is returned with less fuel. Late returns may incur additional fees, so notify us promptly if you expect to return the vehicle later than scheduled. You will be liable for any parking tickets, traffic violations, or other charges incurred during the rental period, in addition to an administrative fee.
Insurance and Liability Details
- All rentals include basic third-party insurance, with coverage specifics and excess amounts outlined in the Rental Agreement. Additional insurance options may be available to limit your financial liability, and we recommend reviewing these options. You are liable for damage or loss up to the insurance excess amount, unless you opt for additional coverage. Any damage resulting from negligence, misuse, or violation of these Terms remains your responsibility, regardless of insurance.
Cancellation and Modifications
Cancellation and amendment policies differ based on the type of booking and the notice provided. For precise details, consult your booking confirmation or Rental Agreement. Be aware that late cancellations or no-shows may incur additional charges.
7. Restricted Activities
Prohibited Vehicle Uses
- Use of the vehicle for any unlawful purposes is strictly prohibited. Activities such as racing, rallying, or off-roading are not allowed. Transporting hazardous materials, sub-letting to others, or permitting unauthorized drivers is forbidden. Driving under the influence of alcohol or drugs is unacceptable. Additionally, do not exceed passenger or weight limits, or operate the vehicle outside designated geographical areas without prior approval.
Breach of these terms may lead to rental cancellation and extra fees.
8. Liability Limitations
To the fullest extent allowed by English and Welsh law, Ely Car Hire will not be responsible for indirect, incidental, or consequential damages, including loss of profits or data, resulting from your use of our services. Our maximum liability for any claim will not exceed the total rental amount you paid in the previous 12 months. This limitation does not apply to cases of negligence resulting in death or personal injury, or in instances of fraud.
Applicable Law
These Terms are governed by the laws of England and Wales. Disputes will be handled exclusively by the courts in this jurisdiction.
Updates to Terms
We can update these Terms at any time. Changes take effect immediately upon posting on our website. Continued use of our services indicates acceptance of the revised Terms.
